Terms of Service & Compliance Notice

These Terms of Service ("Terms") govern your access to and use of the Dar Amana software-as-a-service platform, manager dashboards, employee workspaces, and related APIs (collectively, the "Services"). By accessing or using our Services, you agree to be bound by these Terms.

1. SaaS Software Nature & Scope

  • Dar Amana is solely an Information Technology (IT) Software Provider offering Enterprise Resource Planning (ERP), internal ledger, cashier management, and record-keeping software to commercial enterprises.
  • Dar Amana is NOT a financial institution, money transmitter, custodian of monetary funds, banking entity, or licensed currency exchanger.
  • The Services do not perform direct money transfers, custody of fiat/digital currencies, or automated settlement of funds between end-users.

2. Regulatory Licensing & Tenant Responsibility

  • Subscribing companies and tenant account owners ('Tenants') are exclusively responsible for obtaining, renewing, and maintaining all mandatory licenses, approvals, and registrations required by Central Banks, Ministries of Finance, and relevant regulatory authorities in their operating jurisdictions.
  • Tenants warrant that their use of Dar Amana software strictly complies with local money-laundering (AML), counter-terrorism financing (CTF), and financial service regulations.
  • Dar Amana assumes zero legal liability for any unlicensed financial operations conducted by Tenant companies using the software.

3. SaaS Subscription & Licensing Agreements

  • All invoices, payments, and fees paid to Dar Amana represent software licensing and technical subscription fees for accessing the ERP platform.
  • Invoices issued by Dar Amana do not constitute receipts for monetary transfers, customer deposits, or financial holdings.

4. Compliance & Audit Cooperation

  • Dar Amana provides technical features (e.g., audit trails, KYC data fields, transaction logs) to assist Tenants in maintaining internal compliance.
  • Dar Amana reserves the right to suspend or terminate software access for any Tenant found by financial authorities to be operating illegally or engaging in fraudulent financial schemes.
